These Terms govern your use of Echo (the "Service"), provided by David ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

Echo is an AI companion that lets you record daily check-ins, receive AI-generated reflections and weekly letters. Echo is not a substitute for professional medical, mental health, legal, or financial advice.

2. Eligibility & Account

You must be at least 16 years old (or have authority to bind your organisation) to use Echo. You are responsible for keeping your login credentials confidential and for all activity under your account, and you agree to provide accurate information and keep it updated.

3. Acceptable Use

You agree not to: (a) use Echo for unlawful purposes, fraud, harassment or spam; (b) infringe the intellectual-property rights of others; (c) attempt to probe, scrape, reverse-engineer, or otherwise interfere with the security or operation of the Service; (d) generate prohibited content including content that is illegal, hateful, sexually explicit involving minors, deceptive deepfakes of real individuals without consent, or designed to enable malware, jailbreaking or circumvention of safety controls.

4. AI-Generated Content

Echo uses third-party AI models. You are responsible for your prompts, what you do with the outputs, verifying their accuracy, and ensuring you have the rights to any content you input. AI outputs may be inaccurate, incomplete, or unsuitable for regulated professional decisions; always exercise your own judgement. We may filter, restrict, or refuse to generate certain outputs and may remove user content that violates these Terms. Repeated infringement may result in suspension.

5. Intellectual Property

Echo, including its software, branding and documentation, is owned by us. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. You retain ownership of the content you write. By submitting content you grant us a limited licence to host and process it solely to provide the Service.

6. Payments & Subscriptions

Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Lemon Squeezy provides customer service inquiries and handles returns. Payment, billing, taxes, cancellations and refunds are governed by Lemon Squeezy's Terms of Service. Subscriptions auto-renew until cancelled.

7. Service Level

The Service is provided "as is". We do not guarantee uninterrupted or error-free performance and disclaim, to the fullest extent permitted by law, all implied warranties including merchantability and fitness for a particular purpose.

8. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated policy violations. On termination, your data may be exported within 30 days of request, after which it may be deleted.

9. Liability

To the maximum extent permitted by law, our aggregate liability is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential or special damages including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence.

10. Changes

We may update these Terms from time to time; continued use after changes constitutes acceptance.
